High Court

According to the Derry Journal today the Carnagarve Group will now take their fight to stop the Sewage Treatment Plant being built there all the way to the High Court.

Despite the Inspector saying in has last report that he didn't think that Carnagarve was a suitable place to site the Sewage Treatment Plant and Donegal Council rejecting a recommendation that it should be sited there and backing the report, An Bord Pleanala overrode Donegal Council and the recommendation of their own Inspector and gave permission for it to go ahead anyway.

Angered

The Carnagarve Group and some members of the Council were further angered when they discovered that one of the five members of the board who voted for it to go ahead anyway, used to work for the major firm that did the modelling work.

Although he was legally entitled to do so as it is more than a year since he worked for the company it was felt that he should have recused himself from the process as it was a potential conflict of interests.

He will be leaving the Board of An Bord Pleanala at the end of this year.

Last Throw of the Dice

At the last meeting of the Carnagarve Group they were told that €10,000 was needed to hire the legal help to challenge the ruling.

It was estimated as there might be 40 families that would support it, that it would take around €250 from each family to fight it and it looks as if they have come up with the money.

It has been a long rearguard action for the group spanning 21-years and they thought they might as well go the extra mile.

Poker Game

It was like a major game of poker where there is a lot at stake and the player at the other side of the table had just bet €10,000 so they had to decide if they would stump up the €10,000 needed 'to see them'.

Well they've now thrown the money into the pot and all that is left is to see what hands they each have and whose hand is legally better.

It should be an interesting finale to this 21-year-old high-stakes poker game with the future of Moville's top beach at stake.
